Pennsylvania DUI DMV Hearing and Appeal
You’ve been charged with DUI and you’re worried—you know the courts are not lenient when it comes to DUI offenders and you’re stressed about the upcoming penalties. The good news is that you have not been convicted yet and our experienced attorneys are ready to represent you and protect your rights like we have done with all of our clients.
But in addition to the penalties you’ll face in court, you may not know that you’ll face a separate penalty with the Pennsylvania Department of Transportation. When the
officer arrested you for DUI/DWI, they were required to submit a notification to PennDot. PennDot will then send you a
license suspension notice, but you do not have to just “sit there and take it.” You should immediately contact our law offices and we will request a hearing on your behalf—but you must contact us now because you only have 30 days from the date you received your notification to request a hearing with PennDot. If you don’t request a hearing within 30 days, PennDot will automatically suspend your license for 12 months. And yes, your license will still be suspended for 12 months even if you’re found not guilty in criminal court!
Another benefit to contacting our law offices is that there are steps involved in requesting this hearing and we can take care of the process for you and possibly avoid the need for you to have a hearing with PennDot at all. From taking care of the necessary paperwork to representing you during the hearing, you’ll want the our lawyers on your side!
What happens during the hearing with PennDot?
Remember that this is a civil proceeding so there won’t be a judge, but instead a Department of Transportation official. They will determine if the police officer had probable cause to stop you and whether or not they had a legal right to arrest you.
If you were given a chemical test, your results will be reviewed during the hearing and they will make a decision as to whether or not this is cause to suspend your license.
